1. Who you are dealing with

baby postbox (babypostbox.com) is operated by Elliot Robinson, a sole trader based in the United Kingdom. Where these terms say “we” or “us”, that is who they mean. You can reach us at hello@babypostbox.com, and we answer every message ourselves.

By opening a postbox, or by posting into someone else’s, you agree to these terms.

2. What you are buying

A postbox is a private web page for one child. You and the people you share the link with can add letters, photos, videos and voice notes to it. One or two people can look after it as administrators. When you decide the time is right, you can hand it over to your child with a separate link, and they open it a post at a time.

It is a keepsake, not a backup service. You can download the whole postbox at any time, and we would encourage you to, because a copy on your own computer is safer than any promise we could make.

3. Price and payment

A postbox costs £59. That is one payment for that postbox, with no subscription and nothing to renew. A second child needs a second postbox.

The price includes UK VAT where it applies, so the amount you are charged is the amount shown on the page.

Payments are processed securely by Stripe. We do not see or store your card details, and by completing the checkout you agree to Stripe’s terms for the transaction. If a payment does not complete, no postbox is created.

4. Your right to cancel, and refunds

A postbox is digital content, delivered immediately. Under the Consumer Contracts Regulations you would normally have 14 days to change your mind, but that right ends once delivery has started with your agreement. By opening a postbox you ask us to start straight away and accept that you lose the 14 day cancellation right at that moment.

That is the legal position, and it is not how we intend to behave. If something has gone wrong, or you bought it by mistake, write to hello@babypostbox.com and we will sort it out. Nothing here affects your legal rights if what we sold you is faulty or not as described.

5. Gifts

If you buy a postbox as a gift, you pay for it and we hand it to the parents. You tell us which email address it belongs to, and until a parent opens it you can correct that address from the link in your inbox. Once a parent takes it up, the postbox is theirs and you have the same access as any other family member.

Please make sure the address is right. If a postbox is promised to an address nobody can read, we may not be able to reach the family at all, and putting it right is a manual job for us rather than something you can fix on the site.

6. Your posts, and our site

Everything posted into a postbox stays the property of whoever wrote, photographed or recorded it. We do not claim ownership of it, we do not sell it, we do not use it to train anything, and we do not put it in our own marketing.

You give us only the permission we need to run the service: storing your posts, and showing them to the people who hold the postbox’s links. That permission ends when the content is removed.

The other way round: the site itself, its design, its wording and its artwork are ours. You are welcome to share postbox links as widely as you like, but please do not copy or resell the site.

7. Who can see a postbox

Postboxes are unlisted and are never indexed by search engines. Access works by link. Anyone holding the sharing link can read the postbox and post to it, which is what makes it easy for grandparents, and it also means the link is worth treating carefully. If it reaches someone you would rather it had not, an administrator can change the sharing link, and every copy that is out there stops working.

We cannot tell you who has read a postbox, and we cannot pull back copies that somebody has already saved or forwarded. We would rather say so than imply otherwise.

Being an administrator needs a verified email address, not just a link. Holding a postbox URL never makes anyone an administrator.

8. Looking after it

Administrators are curators, not moderators. There is no approval queue. An administrator can remove any post, remove a person along with everything they posted, rename the child, change the sharing link, and add or remove the other administrator. Those actions take effect immediately. Removed posts and people can be put back for 30 days from inside the postbox, after which they are gone for good.

9. What you agree not to do

Please do not use baby postbox to:

• post anything unlawful, or anything that infringes somebody else’s rights
• post images or recordings of another person’s child without their agreement
• harass, threaten or abuse anyone through a postbox
• attempt to reach postboxes you have not been given a link to, or interfere with how the site runs
• resell or commercially exploit the service

If a postbox is being used for any of these, we may suspend or close it. We will tell the administrators why, and give them a chance to get their content out first unless the law prevents us.

10. Age

You must be 18 or over to buy a postbox or to be an administrator of one. Postboxes are written by adults, about a child, for that child to read when they are older.

11. Keeping it running

We will not promise “forever”, because nobody honestly can. We intend to keep postboxes available and to keep improving them, but the site may occasionally be down for maintenance or for reasons outside our control, and features may change.

If we ever had to close baby postbox down, we would give you as much notice as we reasonably could, and a way to take everything with you before anything was switched off.

12. Removing a postbox

You can remove individual posts and people from inside the postbox at any time. Anything removed waits 30 days in case it went by mistake, and is then deleted for good along with any photo, video or recording. If you want the whole postbox and everything in it deleted, write to hello@babypostbox.com from an administrator’s address and we will do it. It is permanent, so please take a copy of anything you want to keep first.

13. Our responsibility to you

We provide baby postbox with reasonable care and skill. We do not promise the service will be uninterrupted or free of faults.

If we fail to meet these terms, we are responsible for loss you suffer that is a foreseeable result of that failure, up to the amount you paid us. We are not responsible for losses that were not foreseeable, or for business losses.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. As a consumer, you always have rights under the Consumer Rights Act 2015 that these terms cannot take away.

14. Changes to these terms

We may update these terms. If a change materially affects you, we will email the administrators of every active postbox before it takes effect. The date at the top always tells you which version you are reading.

15. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK, you can also bring proceedings in your own country’s courts.

16. Privacy

How we handle personal information, including your child’s, is set out in our privacy policy.
