1. Who you are dealing with

baby postbox (babypostbox.com) is a small independent business based in the United Kingdom. Where these terms say “we” or “us”, that is who they mean. You can reach us at hello@babypostbox.com. Our full trading details are at the end of this page.

By opening a postbox, or by posting into someone else’s, you agree to these terms.

2. What you are buying

A postbox is a private web page for one child. You and the people you share the link with can add letters, photos, videos and voice notes to it. One or two people can look after it as administrators. When you decide the time is right, you can hand it over to your child with a separate link.

It is a keepsake, not a backup service. You can download the whole postbox at any time, and we recommend you keep your own copy.

3. Price and payment

A postbox costs £59 in the United Kingdom and $79 everywhere else. This is a one-off payment, with no subscription and nothing to renew. Each postbox covers one child.

In the UK, the price already includes any tax, so the amount you see is the amount you pay. In the United States, prices are shown before sales tax, and any tax that applies is added at checkout. Anywhere else, the amount you see is the amount you pay.

Payments are processed securely by Stripe. We do not see or store your card details, and by completing the checkout you agree to Stripe’s terms for the transaction. If a payment does not complete, no postbox is created.

4. Your right to cancel, and refunds

We create your postbox and hand it over the moment your payment completes. Buying online normally comes with 14 days to change your mind; by buying a postbox you ask us to supply it immediately, and you therefore agree that the usual 14 day cancellation right for online purchases ends when we do. Wherever you live, any consumer rights the law gives you still apply.

If something has gone wrong, write to hello@babypostbox.com and we will do our best to help. Nothing here affects your legal rights if what we sold you is faulty or not as described.

5. Gifts

If you buy a postbox as a gift, you pay for it and we hand it to the parents. You tell us which email address it belongs to, and until a parent opens it you can correct that address from the link in your inbox. Once a parent takes it up, the postbox is theirs and you have the same access as any other family member. By buying a gift you confirm you are entitled to share the details we ask for about the family: the child’s and parents’ first names, and the parents’ email address.

Please make sure the address is right. If a postbox is promised to an address nobody can read, we may not be able to reach the family at all, and putting it right is a manual job for us rather than something you can fix on the site.

6. Your posts, and our site

Everything posted into a postbox stays the property of whoever wrote, photographed or recorded it. We do not claim ownership of it, we do not sell it, we do not use it to train anything, and we do not put it in our own marketing. By posting, you confirm you are entitled to post what you post: it is yours, or shared with the agreement of whoever it belongs to and of the people identifiable in it.

You give us only the permission we need to run the service: storing your posts and showing them to the people who hold the postbox’s links, together with the technical copies that takes, like resized versions for faster loading, the files in a download, and our short-lived backups. The permission lasts while the content is in the postbox, through the 30 day recovery window if it is removed, and for the short tail that backups or a legal duty to preserve something can add. Then it ends.

We also look at how the service is used, so we can run and improve it: which features get used, and how full postboxes get. That is usage data, never the posts themselves. Our privacy policy explains exactly what is measured.

The other way round: the site itself, its design, its wording and its artwork are ours. A postbox’s sharing link is yours to pass on to the family and friends it is meant for; the site is not yours to copy or resell.

7. Who can see a postbox

Postboxes are unlisted and we tell search engines not to index them. Access works by link, plus a postbox code where the family has set one. Anyone holding the sharing link can read the postbox and post to it, so the link is worth treating carefully. If it reaches someone you would rather it had not, an administrator can change the sharing link, and every copy that is out there stops working.

We cannot tell you who has read a postbox, and we cannot pull back copies that somebody has already saved or forwarded.

Being an administrator needs a verified email address, not just a link. Holding a postbox URL never makes anyone an administrator.

8. Looking after it

Administrators are curators, not moderators. There is no approval queue. An administrator can remove any post, remove a person along with everything they posted, rename the child, change the sharing link, and add or remove the other administrator. Those actions take effect immediately. Removed posts and people can be put back for 30 days from inside the postbox, after which they are gone for good.

9. What you agree not to do

Please do not use baby postbox to:

• upload, store or share anything unlawful. In particular, that means any sexual or indecent image of a child, or any other content that sexualises or exploits a child
• post an intimate image of anyone without their consent
• post images or recordings of another person’s child without their family’s agreement
• harass, threaten or abuse anyone, or promote hatred or violence
• upload anything malicious, attempt to reach postboxes you have not been given a link to, or probe or interfere with how the site runs
• infringe somebody else’s rights, including copyright: please only post what is yours to post
• use baby postbox as general file storage or a way to distribute files. It is a postbox for a child, and we remove content that clearly is not that
• resell or commercially exploit the service

If a postbox is being used for any of these, we may remove content, suspend the postbox or close it. For ordinary breaches we will tell the administrators why and, where we reasonably can, let them download their content first.

None of that applies to content we believe is illegal, especially sexual images of children. We act immediately and without notice: we disable access to the content or to the whole postbox, preserve the content and the information associated with it, report it to the National Crime Agency or another appropriate authority as the law requires of us, and cooperate with any investigation. We will not warn the person who posted it where doing so could prejudice an investigation, and the law may forbid us to.

10. Reporting something that worries you

Every postbox has a “Report a concern” link in its About panel. It reaches us directly, and nobody else in the postbox is told you used it. You can also email hello@babypostbox.com about any postbox or post, whether or not you can sign in. A person reads every report, and where something breaks these terms or the law we act as section 9 describes.

The same address is the way to complain: about a report we did or did not act on, or about anything else. Tell us what happened and we will look at it properly and reply.

11. Copyright, and taking content down

We respect copyright, and by posting you confirm you have the right to post what you post. If you believe something in a postbox infringes your copyright, email hello@babypostbox.com and tell us what the work is, where to find it in the postbox (the link), how to reach you, and that you believe in good faith the content is not authorised and that what you have told us is accurate. We look into every notice, and where a complaint is valid we remove or disable the content. If someone posts infringing content repeatedly, we may close the postbox.

12. Age

You must be 18 or over to buy a postbox or to be an administrator of one, and administering is for the child’s parents or legal guardians, or someone they have asked to help look after it. Postboxes are written by adults, about a child, for that child to read when they are older.

13. Keeping it running

We will not promise “forever”. We intend to keep postboxes available and to keep improving them, but the site may occasionally be down for maintenance or for reasons outside our control, and features may change.

If we ever had to close baby postbox down, we would give you as much notice as we reasonably could, and a way to take everything with you before anything was switched off.

14. Removing a postbox

You can remove individual posts and people from inside the postbox at any time. Anything removed waits 30 days in case it went by mistake, and is then deleted for good along with any photo, video or recording. If you want the whole postbox and everything in it deleted, and you are its only administrator, you can do that from inside the postbox. Where two of you look after it, or if you would rather we did it, write to hello@babypostbox.com from an administrator’s address and we will delete it. Either way it is permanent, so please take a copy of anything you want to keep first.

Two caveats. Deleted information can linger briefly in our encrypted backups, which age out over 7 days, before it is gone from there too. And deleting cannot recall copies that have already left: a download somebody took, or an email already delivered.

15. Our responsibility to you

We provide baby postbox with reasonable care and skill. We do not promise the service will be uninterrupted or free of faults.

If we fail to meet these terms, we are responsible for loss you suffer that is a foreseeable result of that failure, up to the amount you paid us. We are not responsible for losses that were not foreseeable, or for business losses.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. As a consumer, you always have rights under the Consumer Rights Act 2015, or the equivalent consumer-protection law where you live, that these terms cannot take away.

16. Changes to these terms

We may update these terms. If a change materially affects you, we will email the administrators of every active postbox before it takes effect. The date at the top always tells you which version you are reading.

17. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK, you can also bring proceedings in your own country’s courts. And if you are a consumer in the EU, or in any other country whose law gives you that protection, you keep the mandatory consumer rights of your home country and can bring proceedings in its courts. Nothing here takes those away.
